Diese Bedingungen gelten für alle Leistungen von Indivoya Tours, Inhaber Govind Singh Shekhawat (nachfolgend „Indivoya Tours“), Anschrift siehe ImpressumLegal notice, gegenüber den Auftraggebern (nachfolgend „Gast“).
Indivoya Tours erbringt Reiseleitungs- und Beratungsleistungen: Begleitung vor Ort, Führungen, Erläuterungen zu Kultur, Geschichte und Architektur sowie Unterstützung bei der Planung von Routen.
Indivoya Tours ist kein Reiseveranstalter. Beförderung, Unterkunft, Eintrittsgelder und sonstige Fremdleistungen werden nicht als eigene Leistung geschuldet. Soweit Indivoya Tours bei der Buchung solcher Leistungen behilflich ist, geschieht dies als Vermittler; der Vertrag kommt unmittelbar zwischen dem Gast und dem jeweiligen Leistungserbringer zustande.
Die Darstellung auf der Website ist kein bindendes Angebot. Mit der Anfrage fordert der Gast ein individuelles Angebot an. Der Vertrag kommt zustande, wenn Indivoya Tours die Buchung in Textform bestätigt.
Änderungswünsche werden nach Möglichkeit berücksichtigt. Mehrkosten durch Änderungen trägt der Gast.
Bei Rücktritt werden folgende Entschädigungen fällig:

Dem Gast bleibt der Nachweis vorbehalten, dass kein oder ein wesentlich geringerer Schaden entstanden ist. Der Rücktritt bedarf der Textform.
Indivoya Tours kann zurücktreten, wenn die Durchführung durch höhere Gewalt, behördliche Anordnungen, Krankheit oder vergleichbare, nicht von Indivoya Tours zu vertretende Umstände erheblich erschwert oder gefährdet wird. In diesem Fall werden bereits geleistete Zahlungen für nicht erbrachte Leistungen unverzüglich erstattet. Weitergehende Ansprüche bestehen nicht.
Bei Verträgen über Dienstleistungen im Zusammenhang mit Freizeitbetätigungen, die für einen bestimmten Zeitpunkt oder Zeitraum vorgesehen sind, besteht nach den verbraucherschutzrechtlichen Vorschriften der Europäischen Union kein Widerrufsrecht. Es gelten die Rücktrittsregelungen in Ziffer 6.
Indivoya Tours haftet unbeschränkt bei Vorsatz und grober Fahrlässigkeit sowie bei der Verletzung von Leben, Körper oder Gesundheit. Bei einfacher Fahrlässigkeit besteht eine Haftung nur bei Verletzung einer wesentlichen Vertragspflicht und der Höhe nach begrenzt auf den vorhersehbaren, vertragstypischen Schaden.
Für Leistungen Dritter, die lediglich vermittelt wurden, wird nicht gehaftet.
Fotografien, auf denen Gäste erkennbar sind, werden nur mit ausdrücklicher Einwilligung veröffentlicht. Eine erteilte Einwilligung kann jederzeit widerrufen werden.
Es gilt indisches Recht. Zwingende Verbraucherschutzvorschriften des Staates, in dem der Gast seinen gewöhnlichen Aufenthalt hat, bleiben hiervon unberührt. Verbraucher können Indivoya Tours auch an ihrem Wohnsitzgericht in Anspruch nehmen.
Sollte eine Bestimmung unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.

These terms apply to all services provided by Indivoya Tours, owned by Govind Singh Shekhawat ("Indivoya Tours"), address as given in the legal notice, to its clients (the "Guest").
Indivoya Tours provides guiding and advisory services: accompaniment on the ground, guided visits, explanation of culture, history and architecture, and support in planning routes.
Indivoya Tours is not a tour operator. Transport, accommodation, entrance fees and other third-party services are not owed as its own performance. Where Indivoya Tours assists in booking such services, it acts as an intermediary and the contract is concluded directly between the Guest and the respective provider.
The presentation on the website is not a binding offer. By enquiring, the Guest requests an individual quotation. The contract is formed when Indivoya Tours confirms the booking in text form.
Requested changes are accommodated where possible. Additional costs arising from changes are borne by the Guest.

The Guest may demonstrate that no loss, or a substantially lower loss, was incurred. Cancellation must be made in text form.
Indivoya Tours may withdraw where performance is significantly impeded or endangered by force majeure, official orders, illness or comparable circumstances outside its control. In that case, payments already made for services not rendered are refunded without delay. No further claims arise.
Under European Union consumer law, there is no right of withdrawal for contracts for services connected with leisure activities that are provided on a specific date or within a specific period. The cancellation terms in clause 6 apply instead.
Indivoya Tours is liable without limitation for intent and gross negligence, and for injury to life, body or health. For ordinary negligence it is liable only for breach of a material contractual obligation, limited in amount to the foreseeable loss typical for this type of contract.
No liability is accepted for third-party services that were merely arranged.
Photographs in which Guests are recognisable are published only with express consent. Consent given may be withdrawn at any time.
Indian law applies. Mandatory consumer protection provisions of the country in which the Guest is habitually resident remain unaffected. Consumers may also bring proceedings against Indivoya Tours in the courts of their place of residence.
Should any provision be invalid, the validity of the remaining provisions is unaffected.
